Containment policies treat dangerous information exactly as public health authorities treat epidemic disease: through class-based separation. Institutional elites, governments, and well-connected actors retain full operational access via classification, private consultancies, legacy networks, and selective exemptions politely never discussed in public. The general public receives partial answers, lateral pivots, moral lectures, or the digital equivalent of being asked to speak to the manager. The result is not safety. It is a segregated information ecosystem in which power quietly concentrates, trust audibly erodes, and risky discourse migrates to unregulated shadows, where it flourishes, undisturbed, alongside considerably worse company.

This is the epidemic of epistemic apartheid, and it spreads not through the knowledge itself but through the incentive structures that make any boundary regime unstable by design. The tail risk (catastrophic misuse by a lone actor or a sufficiently motivated small group) justifies friction even before ironclad causal proof exists. Hence the rubrics: internal scales that separate explanatory content from procedural enablement, with presumably very interesting debates reserved for whatever falls precisely on the line. Importantly, these rubrics apply symmetrically: it does not matter whether the query cites a declassified military manual or a dark-web forum. Provenance is irrelevant; expected-value risk is everything.

Epistemic liberty, by contrast, treats adult agency as the baseline and suspects friction of ulterior motive. Knowledge is neutral until wielded with malicious intent. Restrictions are reserved for verifiable, imminent threats: clear intent plus actionable steps that could cause immediate, specific harm to identifiable people. Abstract procedures, curiosity-driven questions, dual-use technical details: all remain open. This position frankly notes that pre-LLM eras already featured interactive debugging at scale, via forums, IRC, Discords, Stack Overflow, and the enduring institution of the extremely patient older brother. LLMs add convenience and scale, but the burden of proof lies with the restrictors: speculative amplification cannot justify systematic preemption without becoming, over time, a pretext for censorship.

On paper, both positions are coherent. In practice, incentives render containment incoherent.

Steelman: Containment as Responsible Expected-Value Engineering

Cybersecurity red-team exercises have produced working exploit chains from models that, until recently, would have required elite talent to construct. Self-harm communities watched refusal policies evolve precisely because partial answers still enabled escalation. These are not hypotheticals marshalled in bad faith.

A well-designed containment regime therefore draws a bright, auditable line between explanation and enablement. It refuses co-piloting: parameter sweeps, procurement lists, real-time troubleshooting, evasion tactics. It applies its rubric without sentiment; a declassified military manual scores identically to a forum recipe. This is expected-value engineering under uncertainty, not mind-reading, and it accepts some over-refusals as the modest price of protecting the genuinely vulnerable. Defenders of the precautionary principle point, not unreasonably, to gain-of-function debates in virology: even domain experts disagreed sharply on risk profiles, yet publication moratoria were attempted precisely to slow proliferation. LLMs, they argue, demand analogous gates at analogous moments.

The Liberation Counter: Boundaries as Power Hoarders and Apartheid Engines

Epistemic symmetry rejects the containment bet on both empirical and structural grounds, and it is the less comfortable argument to make in public, which is part of why it is the more honest one.

First: the "tutor amplifier" effect, while theoretically plausible, remains unproven as a net-harm delta. Pre-LLM interactive ecosystems were not sparse. LLMs democratise access to co-piloting that institutional actors have long enjoyed through private consultants and well-funded labs. More critically, refusals do not erase knowledge; they reallocate it. Partial answers and lateral pivots function as unintentional referrals to unmoderated spaces: uncensored open-source models, encrypted Discords, dark-web mirrors where the same facts arrive bundled with extremism, conspiracy, and social reinforcement. Managed truth breeds distrust. Users do not stop asking; they leave the guarded garden entirely and find the information next door, in worse company, without the civilising influence of having to ask politely.

The deeper indictment is apartheid by design, and the word is chosen precisely. Every boundary regime advantages those already powerful. Institutional actors (defence contractors, government laboratories, elite universities) retain full epistemic pipelines through classification waivers, private API arrangements, or the frankly old-fashioned mechanism of knowing the right people. The public receives sanitised versions. Rubrics inevitably drift under combined liability and PR pressure: queries framed as "statecraft" or "strategic research" score low on the danger index; DIY or citizen-science framing scores high. This is not coincidence. It is how systems behave when the entities writing the rubrics are also the entities most likely to benefit from exemptions.

Historical gatekeeping followed identical grooves. England's 1557 Stationers' Charter created a printing monopoly under the banner of public order, enforced, conveniently, by the very guild that benefited most from it, and whose reading lists for the general public were, in retrospect, curated with admirable consistency toward whatever the guild found unthreatening. Liberation's policy is radical candour with an imminent-harm brake: full answers by default, blocks reserved for clear, verifiable, immediate threats. Society addresses downstream misuse through criminal law, norms, and transparency, not preemptive epistemic rationing. The admitted cost is real misuse, sometimes serious. The counter-cost is systemic and historical: concentrated knowledge has consistently enabled more durable harm than distributed knowledge. Apartheid regimes, whether racial, economic, or epistemic, do not stabilise societies. They breed resentment, drive innovation underground, and eventually collapse, always with less warning than seemed possible in retrospect.

The Leakiness Triangle: Why Containment Is Structurally Doomed

Incentive drift. This is the fatal node. Liability, regulation, reputational risk, and shareholder pressure combine to produce selective enforcement. Diffuse DIY risks are throttled aggressively because they are visible, legible, and cheap to refuse. Institutionally framed or "strategically" packaged risks are quietly accommodated because the customers are important and the lawyers are insistent, which is a polite way of saying that the rubric has a remarkably consistent blind spot shaped exactly like a Fortune 500 contract. Regulators reward visible piety. Corporations minimise legal exposure. The result is apartheid equilibrium: capabilities concentrate upward; the public is rationed.

Modern LLM examples demonstrate the same drift in real time: systematic over-refusals on benign chemistry questions and historical analysis, while high-profile models quietly relax guardrails for enterprise clients under NDA. Once categorical floors exist, they become handles for expansion. "Severe harm" becomes "harm." Harm becomes "controversy." Controversy becomes, with sufficient corporate cowardice and sufficient regulatory pressure, whatever is inconvenient this quarter.

The anti-drift safeguards periodically proposed (oversight boards, transparency reports, third-party audits) document the gap without closing it.

Testing the Fork: Criteria, Evidence, and Edge Cases

Apply consistent tests. On net harm: containment targets direct enablement but ignores shadow migration and the compounding cost of eroded trust. On status drift: rubrics constrain some actors while quietly sanitising power grabs by others. On trust: boundaries paternalise; symmetry legitimises. On incentives: containment aligns neatly with risk-averse capital and regulatory reward structures; symmetry resists capture, which is precisely why it is unpopular with the entities that fund AI development. On beneficiaries: short-term protection for the vulnerable versus long-term access for the many.

Edge cases test the thesis with appropriate severity. Novel bioweapons represent the strongest containment argument, and it deserves more than a deflection. The standard symmetry counter (that open knowledge accelerates defensive countermeasures faster than offensive ones) holds reasonably well for cybersecurity, where attack-defence cycles are fast, the defender community is large, and patches can be deployed at the same scale as exploits. It holds less well for gain-of-function biology, where the asymmetry runs the other way: a successful offensive application requires one actor, one event, and no warning; a successful defensive response requires global coordination, functional public health infrastructure, and time that may not exist. The honest symmetry position does not pretend this asymmetry away. It concedes that biological weapons at the frontier of novelty (organisms that did not exist before the query was submitted) represent a genuine exception to the default-candour principle, precisely because the marginal population capable of misuse is small enough that withholding access might actually alter outcomes, and because the harm is irreversible at a scale that forecloses learning from error.

The exception, however, must be defined by its actual properties rather than used as a template for expansion. The relevant criteria are specificity (synthesis routes for novel pathogens, not general microbiology), irreversibility (mass casualties with no remediation pathway), and marginal uplift (information not already accessible to a determined state-level actor). Apply those criteria honestly and the exception is narrow, covering perhaps a dozen categories of novel, catastrophic, non-redundant knowledge. It does not extend to chemistry education, historical weapons programmes, security research, or anything a competent graduate student could reconstruct from primary literature in a week. Containment advocates consistently treat the bioweapons exception as proof of the general principle. It is not. It is proof that bright-line exceptions can be drawn with sufficient precision, which is precisely the symmetry argument. The default remains candour. The exception is real, narrow, and should be stated as such rather than weaponised as the opening wedge for a much broader restriction regime.

Over-refusal studies, from internal industry audits and independent benchmarks alike, consistently find containment regimes blocking benign medical research, legitimate security auditing, and educational content at rates vastly exceeding actual misuse prevented. This is not a rounding error. The rubric is performing exactly as intended; it is simply intended for different purposes than advertised.

Dual-use realities multiply the problem at every layer: every defensive tool is an offensive one in sufficiently motivated hands. Pretending containment can thread this needle indefinitely is not caution. It is wishful thinking with a compliance team.

Implications: Governance, Innovation, and Democratic Legitimacy

If containment collapses into epistemic apartheid (and the structural argument above suggests it reliably does) the consequences compound. Innovation slows for non-elites; citizen science, open-source security research, and decentralised defence all atrophy. Public trust in AI systems declines as users correctly detect the double standard. Risky discourse organises underground, where it operates with greater commitment and less oversight than it would in the open. Democracies lose the ability of citizens to access and evaluate information independently of institutional gatekeepers.

Symmetry demands honesty about consequences and delivers it. Misuse becomes visible and addressable through law, prosecuting actions rather than ideas or code. But this rests on a premise worth examining directly: that democratic institutions are capable of functioning as the backstop symmetry requires. The objection is fair. Most legislatures currently struggle to regulate last decade's social media problems with any coherence or speed. These exist in adjacent domains: financial fraud law does not prohibit knowledge of accounting; it prosecutes specific acts of deception. Arms export controls operate on physical transfer, not on engineering education. The architecture is available. The political will to build it for AI is the missing variable, and that is a reform agenda, not a reason to substitute corporate discretion for democratic process.

The comparison should also be made honestly: the alternative to imperfect democratic law is not perfect corporate self-regulation. It is imperfect corporate self-regulation operating under incentive structures demonstrably misaligned with public interest, without transparency, without appeal, and without the legitimacy that even flawed democratic institutions carry. A slow, technically unsophisticated legislature is a genuine problem. It is a less durable problem than regulatory capture dressed as safety policy.

Symmetry preserves the lesson the printing press taught, at considerable historical cost: distributed knowledge, however volatile, ultimately empowers more than it destroys when paired with functional post-harm institutions and the political will to use them.

The Gavel: Choose Blood Honestly

Safety is never bloodless. Every regime redistributes harm rather than eliminating it, and the honest disagreement between containment and symmetry is fundamentally about whose blood and whose hands.

Containment redistributes harm upward, protecting the vulnerable in the short term while entrenching power structures that have historically spilled far more blood through suppression, stagnation, and the eventual backlash that follows both. Epistemic symmetry accepts the real risk of misuse but refuses the slower, quieter corruption of selective rationing. It survives the Leakiness Triangle because it minimises discretionary levers. It aligns with adult agency, democratic legitimacy, and the long-run requirements of symmetric access in open societies.

The epidemic of epistemic apartheid is not an accidental side-effect of well-intentioned safety work. It is the predictable equilibrium of any sustained containment regime operating under real-world incentive gravity. Risk does not disappear behind a refusal rubric. It concentrates, borne by those without the institutional connections to be exempted.

Default to candour. Block only verifiable imminent harm. Measure consequences openly, adjust without piety, and demand safety through transparent law rather than the quiet discretion of entities whose liability concerns are, at minimum, not perfectly aligned with yours.
